Acceptance of Terms
By using Novio ELD service, you acknowledge that:
- You have read, understood, and agree to be bound by these Terms of Use
- You are at least 18 years of age and have the legal authority to enter into agreements
- You comply with all applicable laws and regulations regarding electronic logging devices
- You accept responsibility for all activities that occur under your account
FMCSA Compliance: Our service is designed to help you comply with FMCSA regulations (49 CFR Part 395, Subpart B). However, ultimate compliance responsibility remains with you as the carrier.

User Obligations
As a user of Novio ELD services, you agree to:
Account Responsibilities
- Provide accurate and complete registration information
- Maintain the security of your password and account
- Promptly update any changes to your information
- Notify us immediately of any unauthorized use of your account
Compliance Responsibilities
- Ensure proper use and configuration of ELD devices
- Train drivers on proper use of the ELD system
- Maintain accurate records as required by FMCSA regulations
- Address and resolve ELD malfunctions in accordance with regulations
- Ensure drivers have access to ELD user manuals and documentation
Prohibited Activities
When using Novio ELD services, you must not:
- Tamper with, modify, or attempt to circumvent any ELD functionality
- Use the service for any illegal purpose or in violation of any regulations
- Attempt to gain unauthorized access to any part of our systems
- Share your account credentials with unauthorized users
- Use the service in a way that could damage, disable, or impair our systems
- Reverse engineer, decompile, or disassemble any software provided by Novio ELD
- Submit false or misleading information through the service
Legal Compliance: Any attempt to tamper with or falsify ELD records may result in civil and criminal penalties under FMCSA regulations.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. While we strive to provide reliable service, we do not guarantee that our services will be uninterrupted, timely, secure, or error-free.
Limitation of Liability
Novio ELD shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:
- Your use or inability to use our services
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from our services
- Any bugs, viruses, or similar issues that may be transmitted through our services
- Any errors or omissions in any content or for any loss incurred as a result of using our services
Important Disclaimer
While Novio ELD provides tools to help with regulatory compliance, ultimate responsibility for compliance with FMCSA regulations rests with the motor carrier. We strongly recommend regular reviews of your compliance status and consultation with legal experts regarding regulatory requirements.
Termination
These Terms of Use remain in effect while you use our services. We may terminate or suspend your account at any time for any reason, including if you breach these Terms.
Account Termination
Upon termination:
- Your right to use the services will immediately cease
- We may retain your data as required by FMCSA regulations
- You remain responsible for any charges incurred up to the termination date
- All provisions of these Terms that should survive termination will do so
Data Retention After Termination
Following termination of your account, we will retain your data for the period required by FMCSA regulations (currently 6 months for RODS records). After this period, we may delete your data in accordance with our data retention policies.
Changes to Terms
We may modify these Terms of Use from time to time. When we do, we will provide notice by:
- Posting the revised Terms on our website with a new "Last Updated" date
- Sending an email notification to account administrators
- Providing in-app notifications for significant changes
Your continued use of our services after any modification means that you accept the updated Terms of Use. We encourage you to periodically review these Terms.
